A. General information
I. What does this data protection policy govern?
The protection and security of your personal data is extremely important to Liebherr-Hausgeräte GmbH. It is accordingly important to us to inform you of the type of personal data we collect when you visit the MyLiebherr portal (https://home.myliebherr.com) and when using our Liebherr SmartDevice app, how we use this data and what your rights are in relation to your data.
II. What is personal data and what does processing mean?
1. “Personal data” is any information that says something about a natural person. Personal data is not only information that makes a direct reference to a specific person (such as the name or email address of a person), but also information that with appropriate additional knowledge a reference to a specific person can be made indirectly.
2. “Processing” means any measures that are carried out with your personal data (such as the collection, recording, organisation, ordering, storage, use or deletion of personal data).
III. What functions do the MyLiebherr portal and the Liebherr SmartDevice app offer?
1. Among other things, the MyLiebherr portal offers a single sign-on service. After one-off registration and authentication at Liebherr-Hausgeräte GmbH, it allows you to access all the restricted areas and content of the Liebherr offers connected to the single sign-on service (from the participating companies of the Liebherr Group and their authorised dealers or other third parties), by logging on with unified credentials and without having to go through a separate registration process again. The MyLiebherr portal also offers the option of a centralised appliance registration that allows you, for example, to check the warranty period of a registered appliance at any time and to use other services that require the registration of an appliance without being required to provide further information. The MyLiebherr portal also gives you the option to use a platform for acquiring Liebherr products from third parties (also known as the “marketplace”) without registering for the single sign-on service. The marketplace is the central platform for all authorised Liebherr Domestic Appliances shops and it allows you to order goods and services from the respective shops without having to re-enter your personal data if you registered for the single sign-on service.
The MyLiebherr portal accordingly includes a single sign-on service that provides you with a centralised registration and log-on feature, an appliance registration function that allows you to register your appliance and the marketplace where you can, for example, obtain accessories and consumables for your Liebherr fridge and freezer from third-party vendors.
2. After registering for the single sign-on service, the Liebherr SmartDevice app allows you to use various functions in relation to your Liebherr fridge and freezer (for example, to control the temperature of your Liebherr refrigerator and freezer) via a mobile device.
3. In future, we intend making even further offers available to you on the MyLiebherr portal and in the Liebherr SmartDevice app. As soon as a further offer is added to the MyLiebherr portal or in the Liebherr SmartDevice app, we will of course inform you by email.

II. What personal data do we collect and for what purposes and on what legal basis?
1. Log files

You can revoke your consent, for example, by deactivating the error reporting feature in the settings of the Liebherr SmartDevice app or by sending an email to email@example.com. The revocation of your consent will not affect the legality of the processing carried out on the basis of your consent until the revocation. If you revoke your consent, we will delete all references to persons from the data in your error reports.
3. Master data of your MyLiebherr user account
a. In order to use the MyLiebherr portal and the Liebherr SmartDevice app, a MyLiebherr user account is required. When creating a MyLiebherr user account (registration), you are obliged to provide the following information:
In order to prevent misuse and misunderstandings, you need to activate your MyLiebherr user account after completing the registration process. In order to do so, we will send you an email with an activation link to the email address that you provided. Your MyLiebherr user account is activated by simply clicking the activation link in the email. We process your email address and your access password to set up a MyLiebherr user account for you. The legal basis for the processing for this purpose is Article 6 (1) (b) of the General Data Protection Regulation (GDPR).
Subject to you having given us your express consent, we process your email address and the information that you voluntarily provided during registration for advertising and information purposes; specifically, to provide you with information about products and offers as well as other advertising information (for example, competitions and newsletters) via email. Your consent constitutes the legal basis for the processing for advertising and information purposes and is voluntary. Your consent is not a precondition for creating a MyLiebherr user account. If you do not give your consent, we will not use your data for advertising and information purposes. You have the right to revoke your consent at any time with effect from the date of your revocation. The revocation of your consent will not affect the legality of the processing carried out on the basis of your consent until the revocation.
b. If you connect a SmartDeviceBox to your Liebherr SmartDevice app, we add the following data to that of your MyLiebherr user account:

c. No further personal data is stored in your MyLiebherr user account, unless you volunteer such information.
4. Your device data
The Liebherr SmartDevice app requires access to certain functions and your device data for you to be able to use the Liebherr SmartDevice app. In order to do so, you need grant certain permissions on your device. The categories of permissions are defined differently by the manufacturers of devices. On Android, for example, the individual permissions are grouped in permission categories and you can only agree to the permission category as a whole. We however only use the permissions authorised by you to the extent described below:
The Liebherr SmartDevice app needs to access the memory to save the required media content on your device for the Liebherr SmartDevice app to function.
The Liebherr SmartDevice app needs to access the camera of your device to be able to take pictures of the interior of your fridge and to display these within the “stock list” function.
The Liebherr SmartDevice app needs to access the WLAN connection information of your device to connect the SmartDeviceBox to the Liebherr SmartDevice app.
The Liebherr SmartDevice app needs to access the Internet and your network connection to be able to make the functions of the Liebherr SmartDevice app available to you via our web server.
The Liebherr SmartDevice app needs to access push notifications so that prioritised messages, such as alerts or reminders, can be displayed on your device.
We process the data of the above-mentioned permissions to be able to provide you with the services and functions of the Liebherr SmartDevice app. The legal basis for the processing is Article 6 (1) (b) of the General Data Protection Regulation (GDPR).
5. Machine data of your Liebherr appliance and usage data of your Liebherr SmartDevice app
a. In order to use the functions of the Liebherr SmartDevice app, in particular the functions “Appliance control”, “Alarm message” and “Reminders”, the Liebherr SmartDevice app needs to access the machine data of your Liebherr appliance and the usage data of your Liebherr SmartDevice app. The machine data consists of all the operating values and statuses of your Liebherr appliance that are communicated, for example, by the temperature, speed, voltage and door-contact sensors. The usage data is all the data generated by the interaction with your Liebherr SmartDevice app, such as the temperature and special settings, e.g. SuperFrost and SuperCool, that you made. The “Appliance control” function allows you to access the appliance status of your Liebherr appliance (for example, the set temperature and the status of the special functions) via your Liebherr SmartDevice app. The “Appliance control” function also allows you to control the temperature of your Liebherr appliance and special functions, such as SuperFrost and SuperCool, via your Liebherr SmartDevice app. The “Alarm message” function notifies you of critical temperatures, for example, in the event of a power failure or if the door of your Liebherr appliance has been left open. The “Reminder” function sends you messages about events that you have predefined, for example, a reminder to replace the air filter.
b. We process the machine data and usage data in order to provide you with the functions of the Liebherr SmartDevice app (especially the functions “Appliance control”, “Alarm message” and “Reminder”). The legal basis for the processing is Article 6 (1) (b) of the General Data Protection Regulation (GDPR).
III. To whom and for what purposes do we transmit your personal data?
In general, we only provide your personal data to third parties if this is necessary for you to be able to use the functions and services of the MyLiebherr portal and the Liebherr SmartDevice app. In addition, we provide personal data to third parties:
IV. Will my personal data be processed outside the European Union?
No. We only process your data to the extent legally permitted within the European Union on servers in Germany and Ireland.
V. When do you delete or anonymise my personal information?
1. The log data that we process when the MyLiebherr portal is opened is deleted after seven days. The error reports within the Liebherr SmartDevice app are deleted after two years.
2. Cookies are deleted when you logout of your MyLiebherr user account. If you selected the option “Remember my email address” (stay logged in) on the MyLiebherr portal, the cookies are deleted after 30 days. You should however never choose this option if you are working on a public computer or one that is used by several users.
3. The master data of your MyLiebherr user account is automatically deleted if you have not logged in to your MyLiebherr user account for one year. You will be notified by email before the deletion. You then have the option of preventing the deletion by logging into your MyLiebherr user account again. You can also request the deletion of your MyLiebherr user account at any time.
4. The machine data, usage data and the data of your device will be anonymised after two years or when your MyLiebherr user account is deleted. This means that although the data still exists, no personal reference to you can be made.
I. What is profiling?
“Profiling” is any kind of automated processing of personal data which consists in using this personal data to evaluate certain personal aspects relating to a natural person, in particular by analysing or predicting aspects relating to job performance, economic situation, health, personal preferences, interests, reliability, behaviour, location or change of location of that natural person.
II. Is my personal data used for profiling?
No. In order to optimise the MyLiebherr portal and for statistical purposes even when merely accessing the MyLiebherr portal, we only collect non-personal data. For example, we collect the time of the visit, the websites visited on the MyLiebherr portal, the duration the visit, the regional origin and that of the website from which the MyLiebherr portal was called up. We use certified data protection-compliant web analytics software for this purpose from WiredMinds, which collects non-personal data only in an anonymous form. The visitors of the MyLiebherr portal cannot be identified by means of this data. D. How is my personal data protected from unauthorised access and loss?
We use technical and organisational security measures to ensure that the personal data of our users is protected from loss, improper changes or unauthorised access by third parties. Moreover, we ensure that from our side only authorised persons are granted access to your personal data and then only to the extent necessary for the above-mentioned purposes. The use of the MyLiebherr portal (https://home.myliebherr.com) and the use of the Liebherr SmartDevice app shall be subject to the prior registration of the user. By means of the registration service (hereinafter referred to as the “SSO service”), Liebherr-Hausgeräte GmbH offers a central point via which the user obtains access to the modules “Appliance registration”, “Marketplace” and the “Liebherr SmartDevice app” described below in more detail. (The “SSO service” and the modules “Appliance registration”, ”Marketplace” and “Liebherr SmartDevice app” shall hereinafter be referred to as the “offer”.) After registration, the SSO service serves the user as a central login tool.
2.1 SSO service
2.1.1 In the case of the SSO service of HAU, the single sign-on means that each user after a one-off registration via the SSO service shall be granted authorised access to the offer and the other Liebherr portals participating in the SSO service and can then login with uniform access data, without having to go through the registration process for each individual offer.
2.1.2 The user shall receive a portal-spanning “identity” via the SSO service can be recognised and verified by the participating Liebherr portals. In this way, the SSO service also allows the user’s personal data that is stored in the SSO service (such as the user’s name and address as well the appliances registered by the user) to be automatically transmitted to the operators of the respective Liebherr portals without having to manually enter and verify this data at another participating Liebherr portal.
2.1.3 In addition, users can be presented with specific information customised for them via the SSO service. The use of the offers and the other participating Liebherr portals will accordingly be more convenient for the user.
2.1.4 The SSO service allows the users to easily and centrally manage their SSO account. In this way, the users can, for example, manage and correct their master data (e.g. address), change their password.
2.2.1. Appliance registration
The “Appliance registration” module enables users to register their Liebherr fridges and freezers (hereinafter referred to as “appliances”). After registration, the users receive an overview of their registered appliances. In addition to various functions for the management of the appliances, the user can easily switch to the optionally available further modules for the respective appliance.
In the “Marketplace” module, the user has the option of purchasing products from third parties who use the “Marketplace” module as a sales platform. Only original Liebherr products are offered on the “Marketplace” module. Additional costs, such shipping costs and customs duty, are indicated by the seller of the product. Please note that HAU merely grants the third parties the opportunity to sell products. In particular, HAU assumes no liability for the displayed prices, availability and other conditions of third parties.
2.2.3. Liebherr SmartDevice app
188.8.131.52 The Liebherr SmartDevice app offers, among other things, the following functions:
The “Appliance control” function of the Liebherr SmartDevice app allows users to control the temperature of their Liebherr fridges and freezers via the SmartDevice app and, if available for the respective appliance, to control special functions, such as SuperCool and SuperFrost.
The “Notifications” and “Reminders” function allows users to receive information about events in respect of their appliance, such as alarms (door alarm, critical temperature, power failure) and reminders about replacing air filters.
In addition, the Liebherr SmartDevice app offers the option of contacting a Liebherr service partner.
The user also has the option of using the “Lists” function to create an individual shopping list. Furthermore, it is possible to create a stock list via the “Lists” function. In this regard, users can use the camera of their mobile device to create and save an image of the interior of their Liebherr fridge and freezer in the stock list.
HAU shall have the right to change or discontinue, temporarily or permanently, the functions of the Liebherr SmartDevice app at any time and without giving reasons.
2.3 Availability and cost of the offer
2.3.1 The availability of the offer depends on a functioning data connection between HAU, the user or third parties who operate the respective Liebherr portal and the functioning of all the systems involved. Consequently, it cannot be ruled out that access to the offer may be temporarily unavailable. HAU shall be entitled to interrupt the availability of the offer for maintenance and improvement measures to the extent customary in the market. HAU shall endeavour to carry out maintenance and improvement measures outside the normal business hours at the headquarters of HAU.
2.3.2 The use of the offer shall be free of charge for the user.
2.4 Obligations of the user when using the offer
2.4.1 Users shall only register their own appliances and undertake to keep their master data up to date.
2.4.2 The content made available in the offer (text, data, images, logos, graphics, documentation, sound, video and other visual representations) is subject to copyright as well as other laws for the protection of intellectual property. Without the express prior consent of the operator, the content shall not be reproduced, in whole or in part, distributed, stored or changed on other media (e.g. other websites). The printing or saving of individual pages or documents is only permitted for personal use.
2.4.4 The “Lists” function of the Liebherr SmartDevice app allows users by means of the camera on their mobile device to create images of the interior of the fridge, which can then be displayed in the stock list of the Liebherr SmartDevice app. When using the app, users shall only take images of the interior of their Liebherr fridge and freezer. The user expressly warrants that the images created by the user shall not infringe the rights of third parties in any manner and shall not contain any illegal content. The user indemnifies HAU against all claims by third parties arising from a breach of the above-mentioned warranty and obligation.
2.4.5 In order to maintain the functional reliability and functionality of the Liebherr SmartDevice app, it shall also be necessary for the user to install the updates provided by HAU immediately.
3. Identification and registration for the SSO service
3.1 Users must register themselves in order to be able to use the SSO service.
3.2 A user must be 18 years of age in order to be able to register for the SSO service.
3.3 In addition, the user warrants that the information provided by them as part of their registration in respect of their identity, in particular to companies, first and last name, postal address, date of birth and email address, is true and correct. In particular, the user shall not provide the data of third parties. The user shall inform HAU immediately of any changes to the data.
3.4 The submission of the completed registration form represents a formal offer by the user to conclude an agreement on the use of the offer (hereinafter also referred to as the “user agreement”). HAU accepts this formal offer by confirming the registration of the user by email to the user. The respective user agreement is thereby concluded.
3.5 Immediately after the registration form is received by HAU, the user will receive a confirmation email. This email contains a confirmation link. By clicking this link, the user confirms their email address. This confirmation is a prerequisite for the user to be able to login via the SSO service in future, use the offer and make use of services immediately after successfully registering with other Liebherr portals.
3.6 The user shall have no right to be admitted to the offer and the Liebherr portals.
3.7 HAU shall be entitled to decline individual registrations without giving reasons.
4. Use of the access data, access to the Liebherr portals
4.1 The user shall be granted access to the restricted content and offers of the participating Liebherr portals by the user entering their access data, usually an email address and password, into the respective login form.
4.2 The access data is intended solely for the use of the user concerned. The user shall not provide the data, in particular the user’s password, to third parties, not even to family members or colleagues. The user shall keep the access data, in particular the password, secret at all times and prevent the unauthorised use of the participating Liebherr portals by third parties.
4.3 If the user becomes aware of the access data being misused or even if the user only has such a suspicion, the user shall inform HAU thereof immediately. In the event of misuse or suspected misuse, HAU shall be entitled to immediately block access to the Liebherr portals. The user shall liable for all consequences of the use by third parties, insofar as the user is responsible for the misuse of the access data. The user shall be responsible for the misuse, in particular, even if the user permitted the unauthorised use of the access data merely by the user’s negligence. Such liability shall not end until the user has informed the HAU customer service by email (firstname.lastname@example.org) about the unauthorised use and, if necessary, has changed the password.
4.4 Clause 4.3 shall apply mutatis mutandis if the user selects the option “Stay logged in” on a public or multi-user computer and a third party gains access to the Liebherr portals in this manner.
4.6 HAU points out that the Liebherr portals are respectively operated by the company named in the provider identification of the Liebherr portal. Insofar as HAU does not operate the offer itself, HAU shall not be responsible for the content and offers contained therein.
5. Withdrawal of the access authorisation
• Incorrect information is provided during or after registration and/or
• An unauthorised transfer or disclosure of the access data, in particular the password, occurs,
HAU shall have the right to suspend the user’s access data, temporarily or permanently, and/or to revoke the user’s access, with immediate effect or after a notice period at our discretion, and/or to terminate the user agreement extraordinarily and without notice. In such an event, the user shall not be entitled re-register without first obtaining the express consent of HAU.
6. Termination of the user agreement
6.1 The user agreement shall be concluded for an indefinite period. The user as well as HAU shall be entitled terminate the user agreement at any time without a notice period by ordinary termination. In addition, both parties shall have the right to extraordinary termination for good cause. Notices of termination shall be in writing, accordingly at least by email.
6.2 The immediate termination of the user agreement may result in it being impossible for the user to access the registration and accordingly, depending on the offer of a participating Liebherr portal, possibly also the data entered by the user, such as the registered devices, and the access-restricted areas of the Liebherr portals.
This exclusion of liability shall not include claims for compensation due an injury to life, limb and health. Claims for damages due a grossly negligent breach of a duty by the operator, a legal representative or vicarious agent shall also be included in the exclusion of liability.
The above-mentioned limitation of liability shall also not affect any strict liability prescribed by legislation, such as liability in terms of the Product Liability Act, as well as liability for the culpable injury to the life, limb or health of a user.
8. Data protection
The protection and the security of the personal data of our users is very important to us. All the information in this regard can be found in the data protection policy for the offer.
9.3 HAU shall have the right to change or discontinue, temporarily or permanently, the offer at any time and without giving reasons.
10. Final provisions
10.2 If the user is a merchant or if the user has no permanent domicile in Germany, the exclusive place of jurisdiction for legal disputes arising out of or in connection with this agreement shall be the registered office of HAU. Subject to the same conditions, the place of performance for all rights and obligations arising from the contractual relationship with the user shall also be the registered office of HAU.
10.3 If the user is a consumer, the mandatory consumer protection provisions applicable in the state in which the user has his habitual residence shall also apply, insofar as they provide the user with more extensive protection.
